The companies belonging to the La Marzocco Group (hereinafter the “Companies”) and the dealers (hereinafter the “Dealers”) of the products and services distributed by the Companies (hereinafter the Companies and the Dealers are jointly referred to as the “Joint Controllers”) provide, pursuant to Article 13 of Regulation (EU) No. 2016/679 (hereinafter the “GDPR”), information on the processing of personal data carried out by the Joint Controllers in connection with the provision of the “Stay in Touch” service (hereinafter the “Service”), which users (hereinafter the “Users” or “Data Subjects”) request via the relevant forms available on the websites of the Joint Controllers. Please note that the purpose of the Service is to keep Users informed about news from the world of La Marzocco, its events, its products, and its commercial and promotional initiatives.

 

JOINT DATA CONTROLLERS

The Joint Controllers jointly determine the purposes and means of the processing of personal data carried out for the purpose of providing the Service. In this context, the Companies and the Dealers act as joint controllers pursuant to Article 26 of the GDPR, on the basis of the execution of a specific agreement governing their respective responsibilities and obligations. PERSONAL DATA PROCESSED

In order to enable the request for and use of the Service, the Joint Controllers process the Users’ email addresses.

 

WHY ARE PERSONAL DATA PROCESSED AND UNDER WHAT CONDITIONS IS THE PROCESSING LAWFUL?

 

Subject to the User’s consent, personal data are collected and processed in order to allow the User to subscribe to the Service and to enable the Joint Controllers to send, by email, informational and commercial communications relating to news, events, products, and promotional offers that are relevant to and may be of interest to the User (direct marketing).

Subject to the User’s consent, personal data are also collected and processed in order to analyse the User’s interests, habits and consumption choices, as well as their preferences and purchasing behaviour in relation to the products and services offered by the Joint Controllers, with the aim of personalising the informational and promotional communications sent to them (profiling).

PERSONS AUTHORISED TO PROCESS THE DATA

Personal data may be processed by personnel of the Joint Controllers who are entrusted with pursuing the above-mentioned purposes, have been duly authorised by the Joint Controllers, have received appropriate operating instructions, and are subject to confidentiality obligations.

 

RECIPIENTS OF PERSONAL DATA

Personal data may be disclosed to entities acting as data controllers, such as supervisory and control authorities and other public bodies authorised to request the data.
Personal data may also be processed on behalf of the Joint Controllers by entities designated as data processors, to whom appropriate operational instructions have been given. These include, by way of example: (i) companies entrusted with the management and/or maintenance of the Joint Controllers’ websites, and (ii) companies providing products for the management of advertising campaigns and related support services.

 

TRANSFER OF PERSONAL DATA TO COUNTRIES OUTSIDE THE EUROPEAN UNION

Some personal data may be transferred to recipients located outside the European Economic Area. The Joint Controllers ensure that the processing of such data by these recipients takes place in compliance with the GDPR. Such transfers may be based on an adequacy decision, on standard contractual clauses approved by the European Commission, or on another appropriate legal basis. RIGHTS OF THE DATA SUBJECT

The Data Subject may contact the email address privacy@lamarzocco.com at any time to request:

  • access to their personal data (Article 15 GDPR);
  • rectification and completion thereof (Article 16 GDPR);
  • erasure thereof (Article 17 GDPR);
  • restriction of processing (Article 18 GDPR);
  • to object to processing in the event of a legitimate interest of the Joint Controllers (Article 21 GDPR);
  • to receive the personal data in a structured, commonly used and machine-readable format and, where technically feasible, to transmit them to another controller without hindrance (“right to data portability”, Article 20 GDPR).

The User also has the right to withdraw the consent given at any time. In this regard, it is recalled that the withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal.

Finally, the Data Subject has the right to lodge a complaint with the competent supervisory authority if they believe that the processing of personal data relating to them infringes applicable law.

 

CHANGES

The Joint Controllers reserve the right to amend and update this privacy notice in the event that new national or European data protection regulations are introduced.
